Robert Davis (1744-1828) Land Purchase Document*

This indenture made this 6th day of May in the year 1814 between RICHARD CHEEK, OLIVE CHEEK, ROBERT DAVIS and NANCY, his wife, ANDREW WHITE and MARY, his wife, and JAMES CHEEK, of the one part and ADAM WHITE of the County of Moore of the other part, WITNESSETH:

That the said RICHARD CHEEK, OLIVE CHEEK, ROBERT DAVIS and NANCY, his wife, ANDREW WHITE and MARY, his wife, and JAMES CHEEK, for and in consideration of the sum of one hundred fifty pounds to them in hand paid by said ADAM WHITE, receipt whereof is hereby fully acknowledged hereby these presents, bargained, sold and conveyed to said ADAM WHITE, his heirs and assigns forever five-eighths of five tracts or parcels of lands all lying in the County of Moore on the north side of DEEP RIVER and described in the manner following:     

First tract. Beginning at the second corner of CORNELIUS TYSON'S patented tract at a pine, running than south 30 degrees west fifty two poles, thence south sixty degrees west one hundred twenty seven poles across the second tract (JOHN TYSON'S Entry) to the original line, thence along said line south forty-five degrees west to the River, thence down the various courses of the river to the mouth of a small branch and to line of marked trees at the Island ford, then up the said hollow by said marked trees north and northwesterly to a white oak on the original line of first patent (CORNELIUS TYSON'S) thence with the said original line north seventy degrees west to the first station, containing one hundred and fifty acres, more or less.

The second tract Beginning at a 2nd oak in ROBERT CHEEK'S upper line thence north 45 degrees east 127 poles to a red oak thence north 45 degrees west 127 poles to a pine, then south 45 degrees west 127 poles to a mark on the river, thence the courses of the river to the beginning, containing one hundred acres more or less.      

Third tract on TYSON'S CREEK beginning at a turkey oak on the south side of a Stony Hill said to be at or near ROBERT CHEEK'S old corner of 100 acre entry, running north 14 degrees south 35 chains and 36 links between a white oak and pine then north 76 degrees south 35 chains and 36 links to a stake in a gully near two black oaks, a pine and hoppline, then south 14 degrees west 35 chains and 36 links to a stake near two turkey oaks, a hickory and pine, then direct to the beginning, containing one hundred twenty five acres more or less.

Fourth tract Beginning at an oak on CORNELIUS TYSON'S line, now RICHARD CHEEKS, near the mouth of TYSON'S CREEK, then north 70 degrees west 127 poles to a pine then north 14 degrees east 127 poles to a pine, thence south 70 degrees east 127 poles to a stake on the river hank, thence the courses of the river to the beginning, containing one hundred acres more or less.

Fifth tract Beginning at the second corner of CORNELIUS TYSON'S patented tract, a pine. running then south 30 degrees west 52 poles then south 60 degrees west 127 poles across the second tract or patent (JOHN TYSON'S) to the original line then north 45 degrees east to a pine then north 60 degrees east 127 poles to the first station, containing 5 acres more or less.     

The before mentioned tracts or parcels of land five eighths of which are intended to be conveyed, the said RICHARD CHEEK, OLIVE CHEEK, NANCY DAVIS, MARY WHITE, and JAMES CHEEK, are entitled one eighth each as the kin and representatives of ROBERT CHEEK, deceased, and which said several tracts or parcels of land with all the appurtenances thereunto belonging, to the owner's proper use of him, the said ADAM WHITE, his heirs and assigns forever, the said OLIVE CHEEK, ROBERT DAVIS and NANCY, his wife, ANDREW WHITE and MARY, his wife, and JAMES CREEK, for themselves, their heirs, executors or administrators, doth hereby covenant with the said ADAM WHITE, his heirs and executors, that they will forever warrant and defend the right title and interest in fee simple as well for themselves as against the claim or claims of all and every person to him the said ADAM WHITE and his heirs and executors, whomsoever, with all and singular then appertaining thereunto belonging and that they each and every of them will at any time hereafter execute any other instrument or writing necessary for the better answering the true intent of these presents.

In testimony whereof the said RICHARD CHEEK, CLIVE CHEEK, ROBERT DAVIS and NANCY, his wife, ANDREW WHITE and MARY, his wife, and JAMES CHEEK, have hereunto set their hands and seals this day and year above written.

The above deed was duly proven in open court by the oath of JAS. SEAWELL and ordered to be registered.
